This decision provides important insight into your property law. Here is what it changes for you.
The situation
Having found that the corporate purpose of a property investment partnership (SCI) was the acquisition, administration and management by letting or otherwise of all furnished and fitted buildings and real property, and having noted that the transaction had a direct connection with that corporate purpose, the Court of Appeal rightly deduced that, not being a non-professional purchaser, it could not benefit from the provisions of Article L. 271-1 of the Construction and Housing Code.
What the law says
This decision confirms the fundamental principles of property law.
