Where, in the absence of a written agreement or where the agreement is silent, the parties to a public road haulage contract have not stipulated a notice period for termination, that period is fixed by a standard-form contract approved by decree issued pursuant to Article L. 1432-4 of the Transport Code. The provisions of Article L. 442-6, I, 5°, now Article L. 442-1, II, of the Commercial Code do not then apply. The same applies where the written agreement expressly refers to the clause of the standard-form contract fixing such a period. Where the parties have concluded a written contract stipulating the notice period for termination, the provisions of Article L. 442-1, II, of the Commercial Code are applicable. In such a case, the party terminating the contract who has granted its partner a notice period at least equal to that provided for in the standard-form contract in force at the date of notification of termination cannot incur liability under that provision.

Questions fréquentes en droit immobilier

Qu'est-ce que la VEFA (Vente en l'État Futur d'Achèvement) ?
La VEFA, ou "vente sur plan", est un contrat par lequel le vendeur transfère immédiatement ses droits sur le sol et les constructions existantes, tandis que la propriété des constructions futures s'acquiert au fur et à mesure de leur édification. L'acquéreur paie le prix par versements échelonnés en fonction de l'avancement des travaux. Ce dispositif est encadré par le Code de la construction et de l'habitation et offre des garanties spécifiques (garantie d'achèvement, garantie de parfait achèvement).
Quels sont les recours en cas de litige de copropriété ?
En cas de litige en copropriété, plusieurs recours sont possibles : 1) La voie amiable : convocation d'une assemblée générale pour soumettre le litige au vote des copropriétaires. 2) La médiation : recours à un conciliateur de justice. 3) La voie judiciaire : assignation devant le Tribunal judiciaire compétent. Les litiges fréquents concernent le non-paiement des charges, les travaux non autorisés, les nuisances entre copropriétaires ou les contestations d'assemblée générale.
Comment résilier un bail d'habitation ?
Le bailleur peut résilier un bail d'habitation pour motif légitime et sérieux (reprise pour habiter, vente du logement, ou manquement grave du locataire comme le défaut de paiement des loyers). Le locataire peut donner son congé à tout moment avec un préavis de 3 mois (réduit à 1 mois dans certaines zones tendues ou pour motifs spécifiques). La résiliation judiciaire est prononcée par le juge des contentieux de la protection en cas de manquements graves du locataire.
Qu'est-ce que le bornage et quand est-il obligatoire ?
Le bornage est une opération qui consiste à matérialiser les limites entre deux fonds voisins. Il est obligatoire avant toute construction nouvelle, et recommandé lors d'une vente foncière. Le bornage amiable est réalisé par un géomètre-expert. En cas de désaccord, le bornage judiciaire est ordonné par le tribunal. Un procès-verbal de bornage a valeur d'acte authentique et s'impose aux propriétaires successifs.
