The situation
Photographers holding accreditation from the French Fashion Federation who, after photographing several fashion shows, publish the images thus obtained online without authorisation from the holders of the copyright in the creations they reproduce, on a website to which the benefit of their press accreditations does not extend, commit the offence of copyright infringement of intellectual works in violation of authors' rights, without being able to rely on the exception under Article L. 122-5, first paragraph, 9° of the French Intellectual Property Code, as amended by the Law of 1 August 2006, which does not apply to creations of the seasonal clothing and fashion accessory industries.
