The situation
The Court of Appeal misinterprets the clause in the auction conditions of sale that provides: 'the successful bidder shall bear all contributions and charges of any kind with which the property is or will be encumbered from the date set for its entry into possession, as stipulated in the preceding article', by deciding, in order to order a successful bidder company of premises in a condominium building to pay the condominium owners' association the amount of condominium charges in arrears prior to the date of its entry into possession, that this provision requires the purchaser to pay condominium charges predating the date of entry into possession of the successful bidder.
