The situation
Whereas under the terms of Article 57 of Decree No. 72-468 of 9 June 1972 the profession of lawyer is incompatible with all activities of a commercial nature, the Court of Appeal, which rightly held that the acts of a condominium manager, insofar as they are carried out by a non-trader, do not fall within a commercial activity, correctly decided that a Bar Council, when granting a lawyer's application for registration, could not, in the absence of evidence establishing that he was carrying on an activity prohibited by that article, forbid him from acting as a condominium manager.
