Property developer refuses to acknowledge finished renovation

A homeowner in Bordeaux paid a contractor €85,000 to renovate a house, but the contractor avoided scheduling the final 'réception' (formal sign-off) despite the work being finished for over four months. Without this sign-off, the ten-year structural warranty never starts running and final payment remains disputed.

Application pratique:

This 2017-10-12 Cour de Cassation ruling confirms that when no amicable 'réception' takes place, the homeowner can ask the tribunal to order a judicial 'réception' if the works are genuinely ready to be accepted ('en état d'être reçus'). The homeowner should send the contractor a formal letter (mise en demeure) demanding sign-off within 15 days, then, if ignored, file a référé or standard claim before the tribunal judiciaire requesting judicial réception, supported by photos, the building permit, and all payment records. Legal advice should be sought promptly, since the ten-year warranty clock and the five-year limitation period only start once réception is established.

Co-owner contests quality of shared building works

In a Lyon condominium, the syndic organised façade repairs for €240,000 funded by all co-owners, but one co-owner noticed cracks and water staining reappearing within weeks and refused to approve the works at the general meeting. The contractor claims the job is complete and wants the retention guarantee (5% held back) released.

Per the Cour de Cassation's 2017 decision, absence of a voluntary réception doesn't block matters indefinitely: the syndicat des copropriétaires (or a co-owner acting through it) can petition the court for judicial réception if the works are objectively in a state to be accepted, even over one co-owner's objection. The syndic should commission an independent expert report (rapport d'expertise) to assess whether defects are minor (réserves) or serious enough to block réception entirely. If the contractor and co-owners remain at odds, filing for judicial réception fixes a legal completion date, starts the warranty periods, and clarifies whether the 5% retention can be released or must stay blocked to cover remaining defects.

First-time buyer discovers unfinished works before signing

A young couple in Nantes is about to complete the purchase of a newly built house (VEFA, off-plan sale) for €310,000, but the seller-developer has not organised the official réception des travaux with the original building contractor, even though construction finished eight months ago. The couple worries this gap leaves them without protection if defects appear after they move in.

Because this ruling establishes that judicial réception can be requested whenever works are ready to be accepted, even without the builder's cooperation, the buyers' notaire or lawyer should verify réception status before signing and, if missing, require the seller to obtain it (voluntarily or via the courts) as a condition precedent to the sale. If the seller refuses or delays, the buyers can insist on a price reduction or escrow (séquestre) held until réception is formalised, since the ten-year and biennial warranties only run from that date. Consulting a real estate lawyer before signing the acte de vente is strongly advised to avoid inheriting an unresolved réception dispute.
