The situation
In view of an accident that occurred to a pedestrian who fell, in town, on a pavement covered with snow, the trial judges were able to consider that no fault could be attributed to the local residents, the obligation to sweep the snow imposed on them not having been applicable at the time of the accident, which occurred in the evening, whereas it had been snowing since the morning and the snowfall continually increasing made any sweeping operation ineffective.
