A judgment is liable to cassation which, in order to reject a claim, states that its legal basis was changed on appeal contrary to the provisions of the procedural rules of local law applicable to the case, whereas at the date on which the decision was rendered, the new Code of Civil Procedure, in its provisions relating to new claims on appeal, was applicable in the departments of Bas-Rhin, Haut-Rhin and Moselle.
