A judgment cannot be criticised

📅 Décision du 08 May 1979⚖️ Cour de cassation👁️ 3 vues📖 2 min de lecture

No criticism may be levelled at a judgment for having awarded an evicted tenant interest at the statutory rate on the eviction compensation from the date of the summons, since the judgment, having stated that the compensation awarded represented the removal costs incurred before that date, the loss of profit during the transfer and the costs incurred during the production stoppage which it had caused, it follows that the compensation corresponded to the damage already suffered at the time of the summons and that the interest awarded compensated for the delay in making good that damage.
