The existence of a serious dispute prevents the granting of an interim payment in interim proceedings. Consequently, the judge hearing an application for interim relief who, in order to grant an interim payment to an insured person, decides a serious difficulty relating to the insurer's obligation to provide cover and incorrectly holds that the insurer's dispute exposes the insured person to imminent damage, violates Article 809 of the new Code of Civil Procedure.
