Reference decision: Court of Cassation • No. 90-12.677 • 1992-02-19 • View the decision →
This decision provides important insight into your real estate rights. Here is what it changes for you.
The situation
A court of appeal which, noting that from its construction a building was placed under the co-ownership regime, albeit without co-ownership rules, and correctly holding that the descriptive statement of division drawn up on the day of the sale, for the purpose of identifying the units sold, had not changed the legal situation of that building, rightly infers that the tenants' right of first refusal, established by Article 10 of Law No. 75-1351 of 31 December 1975, is excluded.
What the law says
This decision confirms the fundamental principles of property law.
