When the principal has granted a non-exclusive mandate to sell the same property to several estate agents, he is only obliged to pay remuneration or commission to the one through whose agency the transaction was actually concluded, within the meaning of Article 6 of Law No. 70-2 of 2 January 1970, even if the purchaser had been previously introduced to him by another estate agent, unless that other estate agent can claim damages by proving fault on the part of the seller which deprived him of the completion of the sale (decisions nos. 1 and 2).
