The situation
Does not infringe the principle of the separation of powers the judgment which, in order to refuse, on a claim for compensation for disturbances exceeding the normal inconveniences of neighbourhood caused by a carpentry business, to order the modification of the operation to make it comply with administrative requirements, and to confine itself to awarding damages to the claimant, observes that the latter had built his dwelling house in an industrial zone where the carpentry business was also located, that he could only complain of abnormal disturbances in view of the classification of that zone, that the classification of a business fell exclusively within the remit of the administrative authority, and states that the judicial authority could neither hold that the establishment did not meet the conditions for being classified as it was, nor order the operator to modify its industrial installation until a new classification carried out by administrative means had occurred.
