This decision provides important insight into your property law. Here is what it changes for you.
The situation
If the misconduct committed by an employee who made his employer believe that he was in a certain city on a given date, whereas he was in another, is not sufficiently serious to deprive the person concerned of termination payments given his length of service and taking into account that he did not intend to deceive his employer about his schedule, it is such as to destroy the necessary trust between the parties, in particular because of the employee's managerial responsibilities, and as such constitutes a real and serious ground for termination.
What the law says
This decision confirms the fundamental principles of property law.
