The situation

In accordance with the provisions of Articles 76, 77 and 78 of the Code of Criminal Procedure, a person who, following a search of their home carried out in their presence and with their express consent, agreed to accompany the police officers to the police station without constraint, in order to be heard in a preliminary investigation, may be interviewed before being placed in police custody. This interview is not irregular provided that the notification of rights provided for by Article 63-1 of the Code of Criminal Procedure is given upon placement in police custody, even though, in the interest of the person concerned, the period of this measure was calculated from the start of the search.
