Le Tribunal d'instance connait les seuls litiges pour lesquels compétence lui est attribuée par un texte : il ne peut, hors le cas d'indivisibilité, statuer sur une demande de garantie que si cette dernière ne soulève pas une question échappant à sa compétence à raison de la matière. Landlord sues tenant and letting agent together

A landlord in Lyon files a claim before the local Tribunal d'instance (small claims-style local court) against a tenant for unpaid rent of around €3,200, and also seeks a guarantee payment from the letting agency, arguing the agency's commercial mandate contract makes it liable. The agency's mandate agreement contains complex commercial clauses about liability caps that go beyond the rent dispute itself.

Application pratique:

Under this 1978 Cour de Cassation ruling, the Tribunal d'instance can only rule on a guarantee claim if it does not require interpreting a separate matter outside its jurisdiction, such as a commercial contract, unless the claims are truly indivisible. The landlord should check whether the guarantee claim against the agency is legally intertwined with the rent claim or genuinely separate; if separate, it should be filed before the Tribunal de commerce (commercial court) instead. Before filing, gather the mandate contract, rent ledger, and any agency correspondence, and ask the court clerk or a lawyer to confirm which court has jurisdiction to avoid the claim being dismissed on competence grounds. Acting now avoids wasted court fees and delays of several months.

Co-owner disputes renovation costs via subcontractor guarantee

A co-owner in a Marseille apartment building brings a €5,000 claim before the Tribunal d'instance against the building's syndic (managing agent) for botched façade repairs, and the syndic in turn seeks a guarantee from the construction company under a separate commercial works contract. The construction contract includes technical clauses about liability exclusions that require specialist interpretation.

Application pratique:

This case law confirms that the Tribunal d'instance cannot decide the syndic's guarantee claim against the contractor if doing so requires interpreting the commercial works contract's liability clauses, unless the two disputes are indivisible. The co-owner and syndic should keep the main claim (façade defect) separate from the contractor guarantee claim, and route the latter to the Tribunal de commerce if the contractor is a registered company. Keep all works invoices, the original contract, and expert reports on the defect ready, as these will be needed regardless of which court hears the case. Consulting a lawyer before filing prevents the guarantee claim being struck out for lack of jurisdiction, which would force a costly second procedure.
