The situation
The person who divided a building, after having established co-ownership regulations specifying that the shops could be used for all purposes, imposes on the co-owners, in each of the deeds of sale of the units, restrictions not justified by the intended use of the building, thereby circumventing the prohibition on inserting such restrictions in the co-ownership regulations; these clauses in the deeds of sale cannot therefore be applied.
