Under this 1974 ruling, a location-gérance granted by co-owners in indivision is void if not every co-owner individually meets the legal conditions of professional experience, since the exemption applies to the person, not the indivision as a whole. Before signing, verify that each co-owner meets the current experience requirements, or have the qualifying co-owner take sole management pending a formal partition, or obtain a court/prefectural dispensation. Acting without this check risks the whole lease being annulled retroactively, with the manager able to claim back rent and damages, and no protection under the decree provisions.

A first-time buyer in Lyon is about to purchase a 30% share in a commercial premises whose fonds de commerce is currently let under a location-gérance signed by the previous co-owners three years ago. Before completing, they discover one of the sellers had only just qualified as a trader when the lease was granted.

This case law means that if any original co-owner did not meet the experience threshold at the time the lease was signed, the location-gérance was void from the outset and the buyer could inherit a legal dispute rather than a valid income-generating lease. The buyer should request the notaire to verify each former co-owner's professional history and the date the contract took effect, and insist on a specific warranty clause covering the lease's validity in the sale agreement. If doubt remains, a price reduction or suspensive condition should be negotiated until the point is clarified.

Landlord facing tenant's claim for lease renewal rights

A property owner in Marseille rents commercial premises to two indivisaires operating a hardware store under a location-gérance signed five years ago; the tenant now claims statutory renewal protections under the 1953 decree after the landlord tries to reclaim the premises. It later emerges only one of the two co-owners had the required trading experience when the lease began.

Legal advice should be sought promptly, since raising this argument correctly and within the applicable time limits is essential to recovering possession of the premises.
