Farmer heir wants to keep working farmhouse

In the Dordogne, three siblings inherit their late father's estate, which includes a farmhouse worth approximately €280,000 where one sibling has run a small agricultural business (a vineyard and farm shop) for the past 12 years. The other two siblings want the property sold and the proceeds split equally.

Application pratique:

This 2008 Cour de Cassation ruling confirms that an appeal court can award preferential attribution ('attribution préférentiaire') of a property to the heir who runs their business there, provided the building is genuinely a component of that business rather than merely where they happen to live. The farming sibling should apply to the notary handling the estate, or the Tribunal Judiciaire if siblings disagree, for preferential attribution under Articles 831 and 832 of the Civil Code, backing the claim with business registration documents, accounts, and evidence the premises are indispensable to the trade. The other heirs will still be entitled to a financial equalisation payment ('soulte') reflecting their share of the property's value, so an independent valuation should be obtained early to avoid disputes later.

A woman in Lyon has run a bakery for 15 years from a ground-floor commercial unit that was part of her late mother's estate, alongside two brothers who never worked there. When the estate is settled, the brothers instruct a notary to put the whole building, including the bakery, up for sale on the open market.

Application pratique:

Because the case law establishes that the immovable property housing a fonds de commerce (business goodwill and premises together) can be preferentially attributed to the operating heir, the baker can formally oppose the sale and request attribution préférentiaire before the notary finalises the partage (estate division). She must act promptly, ideally raising the request as soon as the succession is opened, since delays can be read as acquiescence to a straightforward sale. A lawyer can help her demonstrate the direct link between the premises and her registered business (bail commercial, chambre de commerce registration, turnover records) to strengthen her claim before a judge if her brothers refuse to agree amicably.

Co-heir buying out siblings needs financing plan

In Nantes, a man aged 45 wants to keep the €350,000 building where he runs his physiotherapy practice, inherited jointly with his sister, who lives abroad and wants her half paid out in cash within six months.

Application pratique:

Under the principle confirmed by this decision, he can request preferential attribution of the building as the professional actually exploiting it there, rather than being forced into a sale he doesn't want. However, attribution préférentiaire is not automatic or free: he will owe his sister a soulte equal to roughly her share of the property's market value, so he should get a formal valuation (expertise) and line up mortgage or bridging finance before making the request to the notary. If the siblings cannot agree on the value or the payment timeline, either party can ask the Tribunal Judiciaire to rule on the attribution and set fair terms, so early legal advice reduces the risk of a costly contested procedure.
