Landlord claims interest on reduced renovation debt

A landlord in Lyon hired a builder for €50,000 to renovate a rental flat, paying €30,000 upfront. After the work was defective and delayed, the landlord sent formal notice on 1 March 2023. The court later reduced the outstanding balance to €15,000 but did not address interest.

Application pratique:

Under this case law, even though the court reduced the debt, interest under Article 1153 (now Article 1231-6 of the Civil Code) runs from the date of formal notice. You should immediately request the court to amend the judgment to include interest at the statutory rate on the €15,000 from 1 March 2023. First-time buyer seeks interest on reduced builder’s bill

A first-time buyer in Bordeaux purchased a flat and engaged a contractor for €20,000 in urgent repairs. After the builder failed to finish on time, the buyer sent formal notice on 15 June 2023. A court later lowered the amount due to €12,000 because of substandard work.
