The situation
The applicant for nullity is admissible to raise grounds based on the irregularity of acts carried out in a judicial investigation to which he is not a party, and which have been added to the proceedings, where he alleges an infringement of one of his rights which was committed in the separate proceedings or that the documents filed are likely to have been unlawfully obtained. The res judicata authority attached to a decision rendered, on an application for nullity, in the context of the judicial investigation to which he is not a party cannot be invoked against him
