The situation
The right to "bois bourgeois", which is granted to natural persons fulfilling various conditions relating to their person and is subject to the condition that those persons are domiciled and not merely permanently resident in a building located within the municipal territory of Engenthal or Dabo, constitutes a personal and exclusively individual right, inalienable, non-assignable and non-transferable by inheritance. The court of appeal therefore made an exact application of Articles 637 and 2226 of the Civil Code when it deduced that this right is not attached to the building and cannot be time-barred even if the beneficiaries have not exercised it for more than 30 years.
