This decision provides important insight into your property law. Here is what it changes for you.
The situation
An economic interest grouping that brings together regional contractors holding an exclusive licence to use and exploit a trademark for the construction of individual houses, but which conceals, in all its documentation, the legally independent nature of the local concessionaires and leads the subscribing owners to believe that it is a nationwide company, having the proposed construction carried out with its assistance, under its control and with the guarantee of its qualification, is held jointly and severally liable, together with the local concessionaire whose assets have been wound up and who has not carried out the works, for the refund of the advance payments received and for the payment of damages.
What the law says
This decision confirms the fundamental principles of property law.
