Landlord discovers tenant housing an employee rent-free

A landlord in Lyon lets a two-bedroom flat to a small business owner; two years later, a routine visit reveals that one bedroom has been permanently given over to an employee who lives there and receives post at the address. The lease contains a standard clause prohibiting subletting without the landlord's written consent, and no consent was ever requested.

Application pratique:

Under this 1972 Cour de cassation ruling, putting part of the leased premises at an employee's disposal counts as unauthorised subletting, even without rent being charged. The landlord should send a formal notice (mise en demeure) citing the breach of the no-subletting clause, then, if the situation continues, apply to the court for termination of the lease (résiliation) — but should be aware that judges retain full discretion (pouvoir souverain) to decide whether the breach is serious enough to justify ending the tenancy rather than a lesser sanction. Gathering evidence (utility bills, witness statements, post addressed to the employee) before acting is essential, since the outcome depends on how the judge weighs the facts.

Commercial tenant lodging staff in leased retail space

A restaurant owner leases commercial premises in Bordeaux and converts an unused storage room above the kitchen into a small studio where the head chef stays free of charge during the working week, roughly 120 nights a year. The commercial lease bars any subletting of all or part of the premises without the landlord's prior written agreement.

Application pratique:

This case law confirms that free occupation by staff still qualifies as a sublease for lease-clause purposes, regardless of whether rent changes hands. The tenant should regularise the situation immediately by requesting the landlord's written authorisation, or should stop housing the employee on-site, since continuing without consent exposes them to a termination claim. If the landlord does bring proceedings, the tenant should be prepared to argue mitigating factors (short duration, business necessity, no financial gain) because the judge's discretion over termination cuts both ways and minor, easily-remedied breaches are sometimes treated more leniently.
