The situation
The dispute between an auxiliary teacher and the Episcopal college employing that teacher falls within the jurisdiction of the employment tribunal, since that college, which, as a diocesan seminary, a recognised institution of Catholic worship in the Bas-Rhin department, constitutes a public body, also admits pupils not destined for the ecclesiastical state and is bound to the State by a contract of association governed by the Law of 31 December 1959, Article 1 of which recognises the particular character of private educational establishments.
