Toulouse is one of the most dynamic cities in France for new-build property. With major projects like Toulouse EuroSud-Ouest (TESO), the High-Speed Rail Line (LGV) and the growth of Montaudran Aerospace, the off-plan property (VEFA) market is booming. But buying off-plan comes with specific risks you need to know before signing any contract.
For a complete understanding of the general legal framework of VEFA (reservation contract, mandatory guarantees, withdrawal periods, national remedies), see our vefa-vente-etat-futur-achevement-recours-garanties?lang=en">Complete VEFA Guide 2026.
1. Property Developers in Toulouse
Toulouse has many developers both national and regional: Icade, Nexity, Bouygues Immobilier, Vinci Immobilier, Kaufman & Broad, and regional developers like Les Nouveaux Constructeurs and Promeo. Before reserving a property, you must verify:
- The Financial Completion Guarantee (GFA) — mandatory for every developer
- The developer's track record on recent Toulouse projects
- The building permit has been obtained (checkable at Toulouse city hall)
- The delivery timeline announced and the late-delivery penalty clauses in the contract
2. The Reservation Contract and Deposit
In Toulouse new-build, the reservation contract (contrat de reservation) is the first step. You pay a deposit (maximum 5% of the price, or 2% if delivery is within 1 year). This deposit is protected: it is held in a escrow account and is fully refundable if your mortgage loan is refused (subject to a loan contingency clause in the contract).
You also have a 10-day cooling-off period from the date of signing the reservation contract, during which you can withdraw without penalty.
3. Mandatory Guarantees in VEFA
Since the ELAN law (2018), every developer must provide the following guarantees:
- Financial Completion Guarantee (GFA): ensures the project will be completed even if the developer goes bankrupt
- Perfect Completion Guarantee: 1 year from the handover date, covering any defects reported
- 2-Year Warranty: covers detachable equipment (appliances, fixtures) for 2 years
- 10-Year Structural Warranty: covers structural damage that compromises the building's solidity
4. Delivery Delays: Your Legal Rights
Late delivery is the most common dispute in VEFA transactions in Toulouse. Here are your rights:
- Late-delivery penalties: typically 1/3000th of the price per day of delay (check your contract)
- Formal notice: send a registered letter (lettre recommandee avec AR) to the developer
- Contract cancellation: possible if the delay is excessive (generally more than 6 months)
- Damages and interest: for separate losses (relocation costs, temporary accommodation, etc.)
5. Construction Defects and Compliance
In Toulouse, the most frequent defects concern:
- Non-conformities between the sales plan and the actual delivery (surface area, materials, equipment)
- Hidden defects: issues not apparent at the handover (soundproofing, damp, cracks)
- Abnormal neighbourhood disturbance related to construction sites and nearby developments
Always hire a building expert to attend the handover inspection. Any reservations must be made in writing. For hidden defects, you can activate the 10-year structural warranty.
6. Toulouse-Specific Considerations
- PLUi-H of Toulouse Metropole: the intercommunal urban plan that takes housing needs into account
- ZAC (Development Zones): numerous projects in ZAC areas like Cartoucherie, Borderouge, and Malepiere
- RE2020 Thermal Regulations: applicable to all new-build programs, with reinforced requirements for the Occitanie region
- Tight rental market: investing in VEFA in Toulouse benefits from strong rental demand, especially in popular neighborhoods
7. When to Consult a Specialist Lawyer?
It is strongly recommended to consult a real estate lawyer in the following situations:
- Before signing the reservation contract
- In case of significant delivery delays
- If construction defects appear after handover
- To negotiate late-delivery penalties and damages
- In the event of a dispute with the developer
