If, before the judicial courts

📅 Decision of 23 August 2026🔄 Updated on 11 October 2026⚖️ Cour de cassation👁️ 14 views📖 2 min read

If, before the judicial courts, private individuals may invoke the breach of administrative regulations establishing planning obligations or public-interest easements, it is on condition of proving the existence of personal damage which is directly causally related to the said breach. The demolition of a building cannot therefore be ordered, built at a distance from the boundary line of the neighbouring plot contrary to the requirements of a prefectural order, on the ground that this construction suffocated the adjoining garden and reduced its amenity, without examining whether this nuisance and these disadvantages resulted directly from the breach of planning regulations and would not have occurred if the building in question had been sited differently.
