The situation
Having noted that the requirements whose violation was invoked by a plot owner were contained in a document entitled "regulations applicable within the housing estate", of which article 1-2 specified that it laid down the rules and easements of general interest imposed on the owners of the plots comprised in the land base of the housing estate and which supplemented the land use plan applicable to the municipality in zone II NA, that the title of the document, the definition and scope of the regulations and the headings under which these requirements appeared demonstrated that they were town planning rules, a court of appeal correctly deduced that this document had a regulatory nature.
