The situation
In view of the distribution of a company's activities into four business divisions including in particular a 'décriquage' division having its registered office in Moselle, and into five regional divisions among which is the 'Midi Méditerranée' division, the district court with territorial jurisdiction to hear the annulment of the staff delegate elections of the 'décriquage' division, which had taken place within its jurisdiction in Moselle, was able, owing to the indivisibility of the applications brought before it, to declare itself competent to hear the annulment of the elections of the décriquage Midi Méditerranée division, it being of little importance in this regard that the local district court could also have been validly seised of the matter.
