It follows from Article L. 480-7 of the Town Planning Code that although, in the absence of any provision in the decision, the period within which the measure in rem must be carried out runs from the day on which the decision becomes final, its starting point is the day on which the judgment or order is handed down when the court orders provisional enforcement. A court of appeal which orders the restoration of the premises within a period of two months from the day on which its judgment becomes final, while at the same time ordering provisional enforcement of its decision, is liable to be quashed.
