This 2006 Cour de Cassation ruling confirms that meeting the minimum legal acoustic standards does not automatically shield a builder or landlord from the ten-year structural guarantee ('garantie décennale') if the defect still makes the property unfit for its intended use. The landlord should immediately notify their decennial insurer and the original contractor's insurer, as the claim may still be covered even though the works were technically compliant. They should also gather the original compliance certificates and commission an independent acoustic survey to establish whether the noise level, despite meeting the norm, renders the flat unliveable. Acting within the ten-year period from the works' completion date is essential, as this guarantee lapses automatically afterwards.

New-build buyer in Nantes hears every neighbour

A couple bought a new-build flat in Nantes (Loire-Atlantique) three years ago for €260,000, relying on the developer's certificate of compliance with building regulations. They now realise they can hear their upstairs neighbours' conversations and TV through the ceiling, and the developer refuses to act, citing full regulatory compliance.

Application pratique:

Under this case law, the developer cannot rely solely on the compliance certificate to escape liability under the decennial guarantee, since compliance with norms does not exclude the existence of a defect covered by the guarantee. The buyers should send a formal letter (mise en demeure) to the developer and their decennial insurer describing the defect and demanding an expert assessment ('expertise'), ideally a court-appointed expert if the developer refuses dialogue. They must act before the ten-year anniversary of the official handover (réception des travaux) of the building, as this is a strict limitation period. A short consultation with a real estate lawyer can help frame the claim correctly to maximise the chance of a favourable expert report and compensation for remedial works.

Co-owner in dispute over works needed for soundproofing

In a co-ownership building in Bordeaux (Gironde), one owner wants the syndic to approve and fund corrective acoustic works for a floor between two units, estimated at €9,000, but other co-owners oppose the expense, arguing the building already meets regulatory noise standards. The dispute is due to be voted on at the next general assembly.

Application pratique:

This ruling is a strong legal argument for the owner seeking works: regulatory compliance alone does not prove the absence of a defect covered by the decennial guarantee, so the syndic cannot dismiss the claim purely on that basis. The owner should request that the general assembly commission an acoustic expert report before voting, and should check whether the original builder is still within the ten-year guarantee period, in which case the insurer should be called in rather than the co-owners' funds. If the guarantee period has expired, the owner will instead need to rely on ordinary co-ownership rules on common-area defects, which is a different and weaker legal basis. Consulting a lawyer before the vote will help the owner present the right legal grounds to the assembly and avoid an unfavourable decision.
