The situation
The prohibition of tourist letting of hotel rooms located in the territory of certain municipalities, decided by a prefect due to the particular risk of spread of the COVID-19 virus presented by this category of establishments, constituted a closure of the hotels concerned. A court of appeal therefore violates such an order when it holds that this text cannot be regarded as the materialisation of the risk of administrative closure of the establishment in the event of contagious diseases or infections, covered by an insurance contract.
