Co-owner challenges caretaker's lodge status

In a 1960s co-ownership in Nice, the caretaker's lodge is listed as Lot 42 with 50/1000ths in the division schedule, but the regulations classify it as common parts. A resident disputes charges allocated to this 'lot', seeking to have it declared common.

Application pratique:

Based on the 1975 Cour de cassation ruling, when regulations and division schedule conflict, the regulations prevail. The caretaker's lodge is thus a common part, not a private unit. The resident should request the syndic (property manager) to correct the charges and, if needed, apply to the tribunal judiciaire to confirm the common status.

First-time buyer misled by division schedule

In Lyon, a first-time buyer signs a reservation for a flat in a co-ownership where promotional materials show a caretaker's lodge as a separate lot with 30/1000ths for sale at €25,000. The regulation, however, classifies it as common parts.

Application pratique:

The case law confirms that contradictory classification means the regulation takes precedence. The lodge cannot be sold privately. The buyer should immediately notify the notaire (conveyancing solicitor) and cancel the reservation, as the seller has no right to sell a common part. Investor purchases caretaker's lodge as rental unit

An investor in Marseille buys a ground-floor caretaker's lodge listed in the division schedule as Lot 15 for €40,000, intending to rent it out. Later, the co-owners' union claims it is a common part per the 1968 regulations, challenging the sale.

Applying the 1975 decision, the lodge is legally a common part despite being in the division schedule. The investor's title deed is voidable. The investor should negotiate with the syndicat (co-owners' association) to either formalise a change of use (if unanimously approved) or seek annulment of sale and damages from the seller, and immediately engage a property lawyer.
