Reference decision: Court of Cassation • N° 94-14.544 • 1995-12-12 • Consult the decision →
This decision provides important insight into your property law. Here is what it changes for you.
The situation
Noting that the sugar cane stumps planted by the former tenant of a rural property are incorporated into the soil and give rise to compensation for the latter in respect of agricultural improvements, but not to the right to sell immovable property owned by the landlord, a court highlights the mismatch between the title of the deed presented for registration and its content, and rightly deduces that this deed concerned the tenant's right to compensation, a movable right subject to the fixed duty provided for by Article 732 of the General Tax Code.
What the law says
This decision confirms the fundamental principles of property law.
