This decision provides important insight into your property law. Here is what it changes for you.
The situation
When, at the date of the withdrawal of a lawyer, no procedural act or irrevocable judicial decision has been made, the prior fee agreement providing for a fee for work calculated on a time-spent basis and a supplemental contingency fee is not applicable, and the fees corresponding to the partial mandate carried out by the lawyer up to that date must be assessed solely by reference to the criteria set out in Article 10, paragraph 2, of the Law of 31 December 1971
What the law says
This decision confirms the fundamental principles of property law.
Key points to remember
- Scrupulously respect the statutory time limits for appeals
- Keep all your supporting documents (title deeds, instruments, correspondence)
- Anticipate: preventive advice is always cheaper than litigation
