Self-builder discovers delivery guarantee issued too late

A couple in Rennes signed a house construction contract (CCMI) with a suspensive condition requiring a delivery guarantee ('garantie de livraison') within 3 months. The builder opened the building site before this guarantee was actually issued, and work was already underway when the guarantee finally arrived, roughly two months after the contractual deadline had expired.

Buyer wants to exit contract after late building guarantee

A first-time buyer in Toulouse paid a 5% deposit (around €15,000) under a CCMI for a €300,000 house. She later learns, after work has already started, that the delivery guarantee was only delivered six weeks after the contractual deadline fixed for the suspensive condition, and now wants out due to unrelated cost overruns.

Because the 2011 ruling establishes that a late-issued delivery guarantee combined with works having already started makes the CCMI void as a matter of public policy, the buyer may have strong grounds to have the contract annulled rather than simply terminated, which can affect what she is entitled to recover. Given the sums involved, she should act promptly and keep all payment records and site-visit photos as supporting evidence.
