The situation

If Articles 570 and 571 of the Code of Criminal Procedure determine the rules according to which an appeal against a decision not terminating the proceedings may be declared immediately admissible, the time limit for appealing against that decision is not suspended until the day of the decision on the merits, said time limit remaining that set out in Article 568 of the same code. Therefore, such an appeal which has not been lodged within the time limit set by that text is inadmissible, even if it is submitted to the Court of Cassation at the same time as the appeal on the merits.
